Summary
The subject of this book is useful and interesting in many ways, especially considering Macedonian aspirations for the EU membership. Therefore, understanding of every aspect of the Union functioning is more than necessary. The author locates his challenge in the institutional structure of the EU. Moreover, the fact that EU has unique structure of institutions, that differs a lot from the institutions in other International organizations, as well as from the structure of institutions in the parliamentary democracies. As future member state of the Union, Republic of Macedonia has necessitate to comprehend how the institutions in the Union are positioned and functioning. Since every state makes concession of the part of its sovereignty to the Union institutions, the decision making procedure is indispensable. The way institutions in the European Union work are unique example of successful balance between welfare of the member states and the supranational interests of the Union. Getting deeper insight in the way how decisions are made within the Union, with reference of every procedure is more than useful.
The first part of the book includes detailed analyses of the institutions that are involved in the decision making procedure: Council of ministers, European Commission and the European Parliament. The author analyses the structure of these institutions, the way they function, as well as the voting procedures within every institution. In addition, author uses cases from the European Court of justice to explain the arguments more deeply.
Second part is dedicated to the Law of the European Union. The Contracts on which European Union is based are legal basis for establishing the secondary acts, enacted by the Union institutions. Throughout the Court practice the author puts down the basic principles of the Union law. Moreover, each secondary act is analyzed in details, since these acts transform the general principles in specific decisions that are implemented in the member states.
Third part contains description of all decision making procedures in the Union: Consultation procedure, Cooperation procedure, Co-decision procedure and Assent procedure. The whole process of decision making is described from its beginning by Commission initiative until the implementation of the decision by some of the implementing procedures. Throughout the decision making procedures, the role of the European Parliament in its growth is analyzed.
The books final part is consisted of the legislative procedures in the Draft Constitution of the EU. The author lists the changes that are about to be made in the institutional structure, as well as the changes in the legislative procedures.
The book is concluded with the annex containing chart description of the decision making procedures. The book structure is well balanced, and the substance is presented in logical order, in an exceptionally lucid manner. |
